The Dukes Of Moral Hazard

No. I'm not dead. In fact, I'm quite well actually…but I've been so schedule-addled (working from afternoons into nights now) and damned busy for what seems like forever that I can hardly find the time to write like I should.

I am DEEPLY sorry for that. Sorry for that, and for not fighting the good fight as I wanted to here through observation and dialogue with you all. I'm sorrier still for missing all the opportunities to cover all the “News” this blog's name demands we should. So many half-done, fitful pieces tucked in their little folders with reference materials and supportive charts and graphics and all that. Pieces that I tell ya— woulda-coulda been great had I gotten them done. Or something like that.

The following piece was last worked on in the Spring/early Summer of last year. I felt very strongly about the issue it spoke to then…and…

Well…it hits home ever stronger today. Here it is, unedited save for a small, updated editor's note dealing with the status of one of the people mentioned within.

The Dukes Of Moral Hazard

Not too long ago, a client I do some work for had a policy in place that pretty much encouraged an activity by its market audience that was going to lead to some innocent people being badly impacted thanks to the wild and self-serving whims of a few. I addressed this to my client, as did others who worked in the same capacity, but responsibility was shrugged off, most classically with the phrase “Hey...we’re not cops.” One co-hort of mine spoke up forcefully to all who would listen, laying out that said client was most assuredly creating a situation of something called “Moral Hazard” . I knew what it meant, having lawyers in the family and an insurance industry professional as a spouse, but some of those it was directed towards (and in the direct position to right the potential wrongs) were in “Duh? Du-u-u-u-u-u-u-hhh?” mode. My co-hort “G” broke it down for ‘em.

G: Moral hazard. (“Sigh!”) You don’t kno—ugh! It’s when you like...knowingly enable a situation that clearly benefits you, but has some elements to it that you know...you KNOW is gonna put some people in harm’s way. Serious harm’s way. Somebody’s gonna get hurt bad.. But you don’t care, ‘cause legally you’re kinda covered. Ethically though...you’re living foul. You know it. Now, we can try to play that shit off, but sooner or later we’re gonna be on the hook when something bad goes down. Watch and see.

CLIENT “A”: I dunno…I think you…might be overstating things.

G: Okay. I'm just sayin', though. You watch and see.


It was only a few months later when the client flipped the script, with a drastic policy change closing those extremely self-favorable but evidently perilous loopholes. Turned out that “G” was exactly right—the bad scenario he would go on to detail had occurred and was exactly what brought on the ol’ switcheroo as people were damaged by the “whatever happens, happens” laissez faire policy and the client was in a position of potentially heavy liability.

Which brings us back...


...to these clowns.

In the heat of the Health Care Reform battle a month or so ago, and quite honestly, ever since around...say, 12:01 p.m. two January 20ths ago, the usual batshitteous wingnut suspects have been in a feces-flinging lather over their ideology’s rejection by a majority of the American people. They chuckled about and cheered on that percentage of the Soreloser-ists who bitterly (Yes, “bitterly”. Funny how no one wants to address that bit of prescience / common sense the then-candidate Obama dared speak publicly on) ramped up their going for their penises guns, post-election loss. They’ve championed the idea of armed insurrection against a hallucinated, tan bogeyman of tyrannous government. They have rationalized threats to life and limb, and simply pooh-poohed blatant assassination-speak against their opponents on the left. Or even the mildly disagreeing middle.

You see, when you come off years of recent skullduggery that makes all the skullduggery of the past look like little more than a smack-your-head-and-go-“Awwwwwww!” game of Stratego™—stealing national elections, lying us into a economy and moral standing-draining war, torturing under the cover of bullshit necessity to mask simple sadism—only to find that “the people” no longer want you at the levers of power that you are addicted to being in the mere proximity of, you will do just about fucking anything and everything, including supporting those who would stoop to damn-near anarchy in America, as long as it means you get to jerk the puppet strings around yet again.

Let's be real, though. Being so bereft of ideas is embarrassing. In a spin-free, reality-based vacuum, said idea-less would look like dimwits. (Sadly, that vacuum has ceased to exist in the last twenty five, cable-news stuffed, centrifuge-action years.) And because the idea-less have no rational counter to the opposing side’s policies and no hold of facts due to truth’s being radioactive to open discussion of their destructive “beliefs”, the last line of defense for them ends up being the public embrace of their lunatic fringe. And it is not just a few in the right’s hierarchy who we find suckling greedily at crazy’s swollen teat. From the House Minority Whip (Now Speaker Of The House—ed.) John Boehner (pictured as “Luke Duke” in the photo-illustration) who screamed like a jumper cable-tortured banshee on the floor of the House as his GOP's obstruction to Health Care Reform dissolved, to wingnuttia’s de-facto dumbfuck standard-bearer Sarah Palin’s whooping up the unsubtle, misspelled placard carrying crowds in her creepy, singsong-y Lonesome Rhodes in-drag- style, to the usually passive-aggressive bitchery/ but now “we really lost”, spiteful, fuck-the-world-ism of good ol’ Insta-fuckwit-gun nut-pundit Glenn Reynolds (“Bo” Duke), it has been a near unanimous embrace-a-nut-a-palooza.

Those few who dare point out the bedshittery of encouraging the extremists come home to find the locks on ye olde wingnut welfare bank vault door have been changed. The American Enterprise Institute’s former sloganeer-in-charge—David Frum, learned this the hard way when he publicly pointed out the clear results of doing the shing-a-ling with the spittle-spraying devils of the fringe.


Dear Arthur,

This will memorialize our conversation at lunch today. Effective immediately, my position as a resident fellow at the American Enterprise Institute is terminated. I appreciate the consideration that delays my emptying of my office until after my return from travel next week. Premises will be vacated no later than April 9.

I have had many fruitful years at the American Enterprise Institute, and I do regret this abrupt and unexpected conclusion of our relationship.

It could have been worse for him, I suppose. They could have just mailed him his stuff, like the Reagan blow-up doll and the sumptuous, corinthian leather waterboarding bench from his old office. Postage-fucking-due, of course.

Where “Moral Hazard” comes into play is when these supposedly intelligent-in-some-ways people willfully hose gasoline onto the white hot fires burning within the worst of their ilk. We saw post-the HCR bill’s passage by the House, a rash of vandalism against property, actual physical threats to lawmakers who dared vote “aye”, and some not very-well-coded threats of something worse than injury to the same. The bad actors? Nearly to a Goddamned man, folks identifying with the super-heated phraseology of the lunatics behaving badly at the public gatherings that the Palins, Boehners and piss-pot Reynoldses have not merely winked at casually, but have vociferously championed.

Championed by playing to these kooks’ base “Duke Nukem” eliminationist fantasies with the “harmless” crosshair-sighting of ideological opponents on their websites and telling the very same people they’ve backed carrying firearms to simple rallies to “Don’t Retreat, RELOAD!‘

Championed by making excuses for the un-democratic and actually destructive acts by the fanatics, and then openly playing to them by mimicking their all-too-familiar screaming, screeching and shouting down—except this time on the floor of the U.S. House Of Representatives instead of atop a rickety milk crate on a streetcorner in downtown East Bumfuck where that sort of goonery usually belongs.

Championed by the breathless glamorization of a so-called “movement” whose most fervent members openly...and I do mean openly espouse the hoariest of old racist tropes and rhetoric and at their most moral, barely pooh-pooh said “quackery” as less than inconsequential. Which brings us to their worst pandering—namely the tying things all together with a “Don’t Tread On Me” green and yellow bow of “fuck democracy-ism” by defending the likes of the Hutaree Cult Of Anti-Governmental Crazy—an actual loaded-for-bear group of violence-espousing dead-enders who—guess what?—are ideological brethren to the Teabaggers.

It would be one thing if the heat here was over a basic difference of opinion—a disagreement with policy and direction. But it’s not that. The nexus between the boiling, molten core of the Tea Party “movement” and the pundits and politicos who are gleefully agitating it is the spectacularly unsubtle spectre of cornered-rat violence.

A basic difference of opinion will not move you to bring assault weapons to a town hall debate on health care, to hang nooses to and fro—just out of protest, mind you, or to vandalize opponent's homes and campaign offices. Once violence rears its medusa-head in mere discussions of policy, we have moved from an airing out of differences and debate to terroristic thuggery. And the general rule is: You terrorize when your opponent is someone you hate to the point where your ability to civilly disagree and engage in discussion has effectively left you.

The knifepoint, noose and bullet is the last bastion of the simple-minded zealot.

And when you keep these people madly frothing, knowing full well that you are agitating an unstable core and one of these nuts acts out—because when you talk of “the tree of liberty needing to be refreshed with the blood of patriots”, and you gun-sight ideological opponents and defend anarchic, bomb-making, would-be domestic bomb-tossers—you have tacitly incited that act and are on the hook for it. If not legally, then at the very least in the spirit of the law of basic common sense.

Understand though, that these class and spin-insulated (from their pickled-in-crazy “base”) instigators will try to explain away their non-culpability and cluck their tongues at all the unfortunateness while disingenuously cheering on whatever the awful act committed is, because it still forwards their spiteful “We're not in charge, so fuck the world” narrative.

And if you think the issue of “Moral Hazard” isn’t a worthwhile one with repercussions that can change the course of history, I suggest you go back no further than a mere few years after yours truly here was born—1965.

I was born into and grew up as a member of the old Nation Of Islam in the early 60’s. Muhammad Ali was a family friend as was the late Malcolm X, who was directly and fatally affected by “Moral Hazard’s”...well, hazards.

A mere twelve days after the assassination of JFK, Malcolm went a bit off the reservation if you will, with his infamously blunt “Chickens coming home to roost” statements about the U.S.'s celebration of and willy-nilly meting out of violence domestically and internationally, and tied Kennedy’s murder in as a self-caused by-product of it. Thinking objectively, it was indeed a tough bit of rhetoric, coming so soon on the heels of the world-stunning crime, but actually it was pretty par for the course in terms of the them-vs.-us NOI-speak at the time. The sentiment was one definitely felt in-group, and yes, even in certain circles of über-progressives beyond the Nation, albeit quietly. That said, the words whipped up a vicious anti-Black Muslim backlash, which is doubly ironic when you consider that the group was already under mega-siege by local police departments, the F.B.I., and the C.I.A.’s oh-so-ethical COINTELPRO program. Things actually managed to get worse pressure-wise for the Muslims, and in an effort to create some breathing room, the NOI’s leader, Elijah Muhammad effectively threw Malcolm under the bus via a very public suspension from the Mosque (inside the NOI we simply called it being “put out”) and a printed repudiation of his words.

Now, simultaneous to this, there were also some deep undercurrents of fear and loathing running rampant within the NOI—things the general public had no clue of, but if you were an NOI member and knew people in the hierarchy in the bigger Mosques like New York’s, Boston’s, Chicago’s, Detroit’s, Philadelphia’s and Newark’s, you most certainly knew about it—namely that as the group's leader Elijah Muhammad was in extremely ill health, his natural successor as NOI leader was his second-in-command—Malcolm X, and he, much to the chagrin of his leadership peers was cut from a much different cloth than they were. Like any other religious sect, there were people in charge with a vested financial interest in maintaining the structural status quo that kept them more than just materially comfortable. Malcolm X was not one of these people. He was a hard-ass, an ascetic, and had a pathological dislike of those who profited off the backs of the poor, but extremely charitable followers in the Nation. The fear in the collection-plate grubbing leadership was that should Malcolm ascend to the NOI's leadership upon Elijah's passing, (who would actually hang on “Hyman Roth”-style at death’s door for many years) that the monetary gravy train would end and with it, all of the perks and deference paid to them. (Spike Lee is one of the few non-Nation insiders to pick up on this scandal and notes it as a key plot point in his film “Malcolm X”)

With that, said leadership mounted a well-timed and very self-serving PR assault against Malcolm's so-called “transgressions” that featured great, heaping helpings of superheated, eliminationist rhetoric.

For example:

On July 9, John Ali, a top aide (The NOI National Secretary actually as well as a later exposed FBI plant and informant—ed. note L.M.) to (Elijah) Muhammad, answered a question about Malcolm X by saying that “anyone who opposes the Honorable Elijah Muhammad puts their life in jeopardy.

The December 4th issue of Muhammad Speaks i (The NOI's weekly newspaper—ed. note L.M.) included an article by Louis X (later Louis Farrakhan—ed. note L.M.) that railed against Malcolm X and said that “such a man as Malcolm is worthy of death.”


And then there was the following infamous “satirical” cartoon drawn by Eugene Majied that appeared in the NOI's newspaper “Muhammad Speaks”, depicting not in code, but in blunt visual language to Muslims how things should end for a so-called “traitor” like Malcolm. (The term, “Take his head!” was often roared hyperbolically from behind Mosque rostrums as a call for revenge against those who dared do them bodily harm)



Again, the words in their usual “in our house” context would be more of the usual fire-em'-up hyperbole, as no outside threat's “head” had ever been taken, but that sentiment had never been so literally depicted. This was naked, visceral “snuff”-speak. Words, yes ...but with words you have to be careful when and how you speak and of course know who you are speaking to. You don’t yell “FIRE” in a crowded theatre, nor do you for shits and giggles yell “GUN!” when you see police officers frantically chasing someone down. Bad things can happen.

And very, very bad things happened to Minister Malcolm X.

Much like the loopy, gun-brandishing, conspiracy theory-wedded base of the Tea Partiers, the NOI had its own bag of mixed nuts within. We called them, “Spooky Brothers”. These were the NOI members who most of us kind of shied away from, the scary ones who really, truly, and totally believed in orbiting Motherships spiriting all thirty million of us Black folk away, and the fable of grafted, blue-eyed devils being fashioned 6,000 years ago on the island of Patmos and the like—never considering that a lot of these tales were feel-good, hyper-Black, counter-mythology designed to force out hundreds of years of self-hate that slavery and white supremacism had managed to drill into our heads. No...“Spooky Brothers” were that desperate bunch who couldn’t or wouldn’t discern rhetoric from reality. You could not joke with them. One, a semi-acquaintance of my father's dropped by our home unexpectedly one evening while my dad was still at work and almost pulled a “Cape Fear” number on us were it not for me and two of my three brothers occupying him, whilst another ran to Daddy's job to get him, and when Daddy did get there, he forcibly threw this nut out and pretty much saw to it that he never darkened a doorway within a hundred miles of us again. If there were some never-before-spoken word ten phantom letters of the alphabet past “Z” for “Zealot” to describe what folks like this were, it would have been a perfectly apt one. They were damaged, desperate folks who if not for the psychic life preserver and regimentation of the NOI would have wound up either dead or locked away for having brought death to someone. It was the last-ditch thing they could coalesce around, belong to, believe in. Nuance-free, dead-ender, “Spooky Brothers”.

Sound familiar?

But the “Spooky Brothers” could be sort of useful pariahs in the NOI. Useful in that they would do just about anything you positioned them to if the “order” came from on high, but still, not the sort you went to if you wanted good outside PR. In the end, they were loose cannon fuck-ups. And being fuck-ups you had to treat them the way the NYPD treats fuck-up cops—banishing them to “beats” in the hinterlands where they couldn't cause too much trouble.

In the Muslims' case, those hinterlands was Muhammad's Mosque #25 in Newark, New Jersey—a.k.a. “Spooky Brother Central”. The organization's national hierarchy knew they were there, what they were about and what they were capable of and still pushed that dangerous rhetorical envelope against Malcolm X. And the “Spookies” spookily ate up every bit of the threatening speech, gobbled down every morsel of malice and it metastasized in them, manifesting itself in the end...like so.

Malcolm X's lifeless body being rushed from the Audubon Ballroom across Broadway to Presbyterian Hospital where efforts to resuscitate him failed.

For years afterward, and to our (the old NOI's) eternal shame, many of those in the Nation who spouted that incendiary, threatening bullshit tried to play it off like they had no culpability in egging on the terrible event, especially after Malcolm's historical stock only rose afterward. But as sure as hell they did. They were looking out for their own creepy self-interest, looking to take down the no-bullshit heir apparent, and position themselves better and closer to power...so they said what they said, knowing that there were malleably crazy, eager, subordinate someones who would do what they did. Yes, there were powerful outside entities who did their own part to enable the deed (Yes, I'm looking at you in your sequined, off-the-shoulder gown, J. Edgar) and further a larger and even more destructive agenda, but there the toxic words stand...said by those who said them and acted upon at least in part by those everyone talking knew were capable and anxious to act out.

Only some 35 years later would Louis (formerly Louis X...yes, that aforementioned Louis X) Farrakhan own up to his part in pushing the narrative and fostering the atmosphere that led to Malcolm's murder.

Cold comfort that, but there it is. Moral Hazard, people.

There will of course be the cry that someone is chilling someone's right to speak in laying this nightmare scenario out. That cry will be a supremely hollow one as the people yelling loudest about the “chilling” will be the ones who cheered the disemboweling of The Bill Of Rights post-September 11th, championed the blacklisting of artists who disagreed with the breakneck rush to war, and had no problem with Habeas Corpus becoming little more than a corpse itself when it suited their political desires.

Disagreeing publicly is as American as apple-fucking-pie. But sloppily calling down fatwas for an armed, zealot-filled base to act upon is what the Frum-ian swarthy “evil” are supposed to be known for. When one of our homegrown, whipped-up nuts acts out in his or her fucked-up, ostensibly patriotic duty and gets a person or a group of innocent persons separated from their lives (A-gain), you will see these “Dukes Of Moral Hazard” rush to cover their asses, because we live in an age where every word you blog, bleat, bitch or bloviate lives on no matter how you try to wish it away into the cornfield. You cannot—for lack of a better phrase—un-shoot that gun.

This bears repeating...

Dave Neiwert and John Amato have a book coming out entitled “Over The Cliff: How Obama's Election Drove Driven Right Insane” and it could not be better titled, for that is exactly what has happened. From the actual penning of “Birther” legislation, to the inane, unconstitutional slashes at life, liberty and the pursuit of happiness of Arizona's so-called immigration reform law, to the repeated and spiteful threats of secession from the republic, “teh crazy” has bled over from the supposed fringe to the main Republican Party garment proper, thanks to the right's luminaries having nothing else to offer. With “teh crazy” having become their new normal, all bets are off. The usual self-centeredness, cowardice and amorality is something we could sort of laugh at as the right's public policy motor would comically seize and blow itself to pieces Wile E. Coyote-style, as in Newt's infamous FUBAR-ing of the budget talks with Bill Clinton in '93. This new, brazen, violence-infused tack being taken...

Well...this is being done at “The Dukes Of Moral Hazard's” own peril.

Here's something you may not know: For decades after Malcolm X's assassination, and very quietly I might add, many who helped fan the flames and create the atmosphere for his murder found themselves on the receiving end of extremely rough justice from patient, long-memoried people deeply wounded by his death. Louis Farrakhan himself went underground for an extended time after the death of Elijah Muhammad and the subsequent exposure of his fecklessness left him with little protection from that silent band of revengers who when time and opportunity allowed 'paid it backward' in very final terms to those involved at all levels. But for the grace of God and some very serious back-channel mea culpas, he is somehow still with us. And even with all of that, his F.O.I. security detail still doesn't let their guard down for a second, nearly half a century later. Why?

Because there is the obvious, above-board justice from the court of common sense and the judgement of history but there is also a thing called karmic justice—where one oftentimes reaps exactly what one has sown. You never really see it coming but if you're smart, you know it's out there, a maelstrom of anger churning far, far away that eventually says “Hello” with but a breeze's kiss on the cheek at first. It touches you nonetheless. And then...then baby, you reap the mother-fucking whirlwind.

They are playing with people's lives. Literally. And there is a price for playing with people's lives...for the poor pawns on the board, of course...but also, for those playing and getting off on the awful game itself.

And there it was as of early this past summer. Or rather, is.

It didn't take a Nostradamus to see “teh crazy” coming. Far more influential writers and pundits felt the first raindrops same as I did. Bill Clinton spoke on it ominously. The person most affected, Congresswoman Gabrielle Giffords smelled the storm coming miles away and sounded the siren quite early.

Yet, here we are. Still.

Was Jared Loughner some rabid Teabagger gone 'round the bend? We don't know. He himself may not even know. But the opportunists who helped whip up the toxic. eliminationist, anti-government frenzy and cheered on those who brought and brandished loaded weapons at political rallies and town halls sure as hell is hot did…NOT...HELP.

So, that clucking sound the right's biggest whiners are complaining about? No. It's not the tongues of those of us who foresaw this.





It's just you know...the sound of old friends and family popping in for a visit.

Breaking: President Bush has Shoes Thrown at Him During News Conference



“This is a farewell kiss, you dog.”

The President was uninjured. He joked “All I can report is it is a size 10.”

An Iraqi television journalist hurled two shoes at President Bush on Sunday during a joint news conference Bush was holding with Iraqi Prime Minister Nouri al Maliki to mark the signing of a U.S.-Iraq security agreement.

Bush had just finished his prepared remarks in which he said the security agreement was made possible by the U.S. surge of troops earlier this year, whhen the journalist, Muthathar al Zaidi pulled his shoes off and hurled them at the president. "This is a goodbye kiss, you dog," Zaidi shouted.

Bush dodged the shoes and was not struck. Bodyguards quickly wrestled Zaidi to the floor and hauled him, kicking and screaming, from the room. Two other Iraqi journalists were briefly detained after one of them called Zaidi's actions "courageous."

"This is the end!" shouted the man, later identified as Muntadar al-Zeidi, a correspondent for Al-Baghdadia television, an Iraqi-owned station based in Cairo, Egypt.

Bush ducked both shoes as they whizzed past his head and landed with a thud against the wall behind him.

The U.S. president visited the Iraqi capital just 37 days before he hands the war off to President-elect Barack Obama, who has pledged to end it. The president wanted to highlight a drop in violence in a nation still riven by ethnic strife and to celebrate a recent U.S.-Iraq security agreement, which calls for U.S. troops to withdraw from Iraq by the end of 2011.

"There is still more work to be done," Bush said after his meeting with Iraqi Prime Minister Nouri al-Maliki, adding that the agreement puts Iraq on solid footing.

"The war is not over," Bush said, adding that "it is decisively on it's way to being won."

It was at that point the journalist stood up and threw his shoe. Bush ducked, and it narrowly missed his head. The second shoe came quickly, and Bush ducked again while several Iraqis grabbed the man and dragged him to the floor.

In Iraqi culture, throwing shoes at someone is a sign of contempt. Iraqis whacked a statue of Saddam Hussein with their shoes after U.S. marines toppled it to the ground after the 2003 invasion.

Bush brushed off the incident, comparing it political protests at home.

"So what if I guy threw his shoe at me?" he said.

In many ways, the unannounced trip was a victory lap without a clear victory. Nearly 150,000 U.S. troops remain in Iraq fighting a war that is intensely disliked across the globe. More than 4,209 members of the U.S. military have died in the conflict, which has cost U.S. taxpayers $576 billion since it began five years and nine months ago.
Iraq war: $576 billion in admitted costs to date. Not counting future costs such as VA costs for treating PTSD and other long-term health costs. Plus rebuilding Iraq, if we have the stones to own up to our liability.

Plus over 50,000 U.S. wounded, not to mention around one million Iraqi dead and wounded.

But let's not mention them. 'Cause coloreds don't count.

We just gave $700 Billion to bail out Wall Street, but can't afford $25 Billion to save the jobs of American auto workers.

Fuck dead brown people. Who gives a shit?

There's absolutely nothing more dangerous in the world than standing between a frightened white man and the door.

Between a WASP and money...

Between a WASP and oil they know damn well should be theirs.

Young Man Awarded $2.5 Million After Beating by Imperial Klans of America

The KKK tried to kick Jordan Gruver to death. By mistake.

They thought he was an illegal immigrant, just another Hispanic.

Actually Jordan is an American citizen. His parents were Native-American and Panamanian. Just a case of mistaken identity.

Not that anything helps when big people are kicking the shit out of you.

An all-white jury of seven men and seven women deliberated for five hours after three days of testimony. The suit alleged that Edwards, Hensley, and the Imperial Klans of America as a whole incited its members to use violence against minorities.

"The people of Meade County, Kentucky, have spoken loudly and clearly. And what they've said is that ethnic violence has no place in our society, that those who promote hate and violence will be held accountable and made to pay a steep price," Dees said.

According to testimony, three members of the Klan group confronted Gruver in July 2006 during a recruiting mission at the Meade County Fair in Brandenberg, Kentucky. They taunted him with ethnic slurs -- inaccurate ones -- spat on him and doused him with alcohol .Two of the men, including Hensley, knocked Gruver to the ground and repeatedly struck and kicked him.

"All I could see was a bunch of feet," Gruver, now 19, told the jury. "As they were kicking me, I prayed to myself. I said, 'God, just please let me go. Please let me make it home.' "

When the blows stopped, Gruver had a broken jaw, broken left forearm, two cracked ribs and cuts and bruises.

He testified that he has suffered permanent nerve damage and psychological trauma. He doesn't leave his house and rarely sleeps more than two hours at a time because he has nightmares, CNN affiliate WLKY reported.

The Southern Poverty Law Center today won a crushing jury verdict against one of the nation's largest Klan groups for its role in the brutal beating of a teenager at a county fair in rural Kentucky.

The $2.5 million verdict will likely cripple the Imperial Klans of America, which has 16 chapters in eight states.

Several Klansmen were at the fair on a recruiting mission when they spotted Gruver, who is a U.S. citizen of Panamanian descent. They threw whisky in his face and called him a "spic." Gruver, who stood 5-foot-3 and weighed just 150 pounds at the time, was surrounded, beaten to the ground and kicked by the Klansmen, one of whom was 6-foot-5 and 300 pounds. He was left with a broken jaw and arm, two cracked ribs and multiple cuts. He now suffers from post-traumatic stress syndrome and has permanent arm and jaw injuries.

The attack on Gruver is symptomatic of a rising tide of hate and violence directed toward Latinos in the United States. The SPLC has documented at 48 percent rise in the number of hate groups since 2000 — an increase fueled by the anti-immigration furor. Recent FBI statistics show a 40 percent increase in hate crimes targeting Latinos between 2003 and 2007.

Former Klansman Kale Kelly testified at the trial that Edwards instructed him to kill Dees during the SPLC's lawsuit against the Aryan Nations in the late 1990s. Kelly said he planned to track Dees in Idaho, where the trial was held, and that Edwards would supply the weapon. But in April 1999, within days of the plot being executed, an FBI undercover operation foiled the plan. Kelly served time in federal prison on weapons charges. Edwards was never charged.

Over the past 25 years, the SPLC has crippled some of the nation's largest and most violent hate groups by helping victims of racial violence sue for monetary damages. Its victories include a $7 million verdict against the United Klans of America in 1987 for the lynching of Michael Donald in Mobile, Ala.; a $12.4 million verdict against the White Aryan Resistance in 1990 for the brutal murder of an Ethiopian student in Portland; and a $6.3 million verdict against the Aryan Nations in 2000 that forced the organization to give up its 20-acre compound in Idaho.
The SPLC does amazing work in the face of violent, ignorant people.

Crooks and Liars

As we predicted before the election, Barack Obama's victory has loosed a flood of hatefulness from the racist right in America. Digby yesterday had a detailed post laying out some of the cases that have erupted so far.

In rural Georgia, a group of high-schoolers gets a visit from the Secret Service after posting "inappropriate" comments about President-elect Barack Obama on the Web. In Raleigh, N.C., four college students admit to spraying race-tinged graffiti in a pedestrian tunnel after the election. On Nov. 6, a cross burns on the lawn of a biracial couple in Apolacon Township, Pa.

The election of America's first black president has triggered more than 200 hate-related incidents, according to the Southern Poverty Law Center – a record in modern presidential elections. Moreover, the white nationalist movement, bemoaning an election that confirmed voters' comfort with a multiracial demography, expects Mr. Obama's election to be a potent recruiting tool – one that watchdog groups warn could give new impetus to a mostly defanged fringe element.

I talked to the SPLC's Mark Potok this morning, and here are his observations:

I think there's something remarkable happening out there. I think we really are beginning to see a white backlash that may grow fairly large. The situation's worrying.

Not only do we have continuing nonwhite immigration, not only is the economy in the tank and very likely to get worse, but we have a black man in the White House. That is driving a kind of rage in a certain sector of the white population that is very, very worrying to me.

We are seeing literally hundreds of incidents around the country -- from cross-burnings to death threats to effigies hanging to confrontations in schoolyards, and it's quite remarkable.

I think that there are political leaders out there who are saying incredibly irresponsible things that could have the effect of undamming a real flood of hate. That includes media figures. On immigration, they have been some of the worst.

There's a lot going on, and it's very likely to lead to scapegoating. And in the end, scapegoating leaves corpses in the street.


Gun sales are up.

Threats against the President-Elect are up. (Thank you Sarah Palin.)

And 2nd & 3rd graders in Rexburg, Idaho repeatedly chanted on their school bus, "Assassinate Obama".

The people who have spent their lives in service of the 28%, do NOT want to live in reality. They will FIGHT to live in the world where whatever fantasy they make up is true.

Jury Verdicts of $2.5 million dollars are good. They help...
  • Wake people up.
  • Fund good education.
  • Shutdown bad people.

OpEdNews Just Wrote About The White Night Riot & Harvey Milk

In May, Maggie Jochild wrote an astonishing piece which I reviewed, The White Night Riot, 21 May 1979, and Lesbians Against Police Violence.

That piece has now been picked up by OpEdNews as Milk and the White Night Riots.

Two weeks from now a long-awaited movie on gay-rights icon Harvey Milk is being released. Maggie will review the movie around when it's released.

The questions include, is the movie a puff piece, does it ignore lesbians in favor of gays, does it make cops look like movie villains instead of real people, and how does it treat politicians (for example, Diane Feinstein?)

In short, how do you tell a movie about a historical time and figure such as Milk and the Riot, when many of the principles are still alive and have strong opinions and memories about the events?

Hit and Run: Pt. 2

Ow!

Yeah, well. So I was hurt. Physically.

After I posted Hit and Run Saturday morning, fell fast asleep and ended up sleeping straight through to 8 pm Saturday, waking up only for standard pain meds. Needed a bit more than normal, but nothing really out of the norm.

At 8 pm Saturday drank the house dry of water, read for a little, then fell back asleep. Nothing to eat, but again, it isn't uncommon for me to go 36 hours without eating. Slept straight through till 1 pm Sunday, then drifted awake over an hour. Again, the only exceptions were waking up every three to four hours for pain and associated meds, taken around the clock.

Two pm Sunday. Tried to sit up. Yelped. (Being an understatement.)

My entire right side was stiff, stiff in the can't be moved and any attempt sends children with knives to stick in your side, way, but it makes no difference as your side is strapped to a board; the children with knives are there just to make it clear NOT to try that shit again.

I'm a FAST learner. I only tried twice.

I thought perhaps I could twist backwards, given twisting frontwards was clearly wrong.

BIG mistake. Huge.

Those little children? They not only were ready and waiting, but they heated the knives and then started doing gymnastic routines from them. Yelping isn't precisely what I did, but let's not frighten anyone.

Eventually I got enough high-level pain meds down I was able to sit, stand, hobble to the car.

About 2:30 pm Sunday, I made it to my favorite dinner for brunch. Walking in they were "Oh my God, what happened to you?!" It was that obvious.

Had a raspberry/blueberry waffle and whip-cream, with a side of bacon, plus a Coke. Sat and answered email for a while and just enjoyed the non-moving. And the absence of any knife-holding little-bastard children.

After brunch, went to the Apple store and bought a new mouse and an extra power-supply. (This eliminates a source of pain, bending over to un-plug and plug-in the power-supply when I leave the house. Now I have a power-supply in my jump bag, and one permanently plugged in. This is the kind of pain-reducing act which is a luxury for most people, but absolutely necessary for people with disabilities.)

Came home. Talked with Kyle. Answered more mail and fell asleep. It's many hours later on Sunday night and here I am, writing.

The pain is intense, but so long as I sit CAREFULLY, I get by.

No ribs were broken in the making of the live-action film JEEP MAN. Just bruising.

Back when I worked as a paramedic I'd say, "I don't have x-ray vision; I don't know if you have broken bones or not." However at this point in my life I've had my ribs broken enough damn times that I DO know if they're broken. These aren't broken; they're bruised real damn good. They'll heal. So would broken ribs, but these will heal more quickly, thank the Gods.

I give this a week-ten days before I'm back to normal. In the meantime, I'll be walking MUCH slower than normal, and sitting down and standing up CAREFULLY. If you are someone whom is physically around me, it's JEEP MAN's fault we are moving so damn slow. (I'm going in to see my doctor tomorrow.)

I find myself genuinely wanting to know what in the frack was going on with Jeep Man late Thursday night, that trying to put a much smaller car (and its driver) into the wall (a Jersey Barrier) Ka-BOOM occurred for him as the smart thing to do. Was he actually trying to kill me? It sure as fuck seemed like it from where I was driving.

What was going on in what passes for his brain?

And now, as it turns out, I'm HURT.

Multiple felonies just got MORE multiple. BAD move, Gidget.

I wasn't hurt. Physically.

So far as I can tell.

It's hard to tell, sometimes, frankly.

And yeah, you bet your ass, I was hurt. Am hurt. Even though I wasn't hurt. Aren't hurt, physically that is. Still fucked me up a little. I always get fucked up a little after someone tries to do me. I'm a medic, not a shooter. That's not an accident of a career choice. Not that I can't shoot; just that I'm a medic.

Here's what happened.

Thursday, Sep 4, late, as I was driving home from Bellevue, my car was side-swiped HARD on I-405 South in a hit & run at about 30 mph.

It was an intentional hit. He was trying to put me into the wall.

Highway construction around 8th had everything shut-down tight, squeezing down to one lane. I got on via the HOV/Bus lane detour which dropped me straight onto the freeway all the way in the far left HOV lane already at full speed.

Within 30 seconds, tops, what little traffic there was, starting squeezing into my lane as the four-lane freeway was narrowed to one by the construction so late at night. We're talking after 10:30-10:45 pm.

I had a jersey barrier to my left, a car very close in front of me with NO room between us, and either an SUV or a truck behind me (night; can't tell for sure.) Whatever it is, it is directly on my bumper. We're at 30 mph and there is no margin for error.

Into this cluster-fuck caused by the construction zone comes a Big Black JEEP. I don't know if that is the actual brand. I suck at branding cars. But it was a jeep-type of car, driving extraordinarily aggressively, and I say this as someone who knows a thing or two about aggressive driving.

He -- if I did get a glimpse of the driver, I'm not admitting it here. I'm being careful not to complicate the legal record with this post, therefore there is stuff which I am not saying. This may well be part of that. In any event, please be clear I'm using "he" only in the traditional grammatical sense of referring to men and women, not in making an eye-witness claim about gender -- kept trying to push his way in to the 12 inch space between my car and the car in front of me.

First, keep in mind everything happened in under 20 seconds. There wasn't any "thinking this through." It just HAPPENED.

Second, there wasn't any room for me to go.

I ran the options very fast.

I've been through so damn many defensive driving schools. It's one of those paramedic skill sets. Every time you go to a new city/county, they make you take a week-long program in how to drive their way. Before you ever touch a patient, including the clinical qual's you have to pass off on just to show you know what you're doing. Driving the rig is ALWAYS first.

Can't drive? Buh-bye.

And by drive, I mean, drive their way. Every fracking new city. I worked all over the goddamn United States. And have never received less than an A- in an Emergency Response Driving course. One time. Normally I get an A or A+.

One of the myths of guys is that each of them is an above average driver. Oh, they know they're not NASCAR drivers. But all of us think, "Well, with just a little bit of training I could be out there banging the paint." It is SUCH bullshit.

Most people are truly average drivers. Most people who think they are above average drivers are dangerous drivers. VERY few drivers have had any kind of actual training. (Watching Tony Stewart's #20 car draft Earnhardt's #8 at Daytona while the camera split-screens showing both of them with their foot glued to the floor, does not constitute "actual training." Especially when you're on your second six-pack.)

I ran the options:

  • Left -- into the jersey barrier. Bounce off out of control, spin across traffic. No.
  • Forward -- take out the car in front of me. Accident MY fault. Double-NO.
  • Backward/STOP -- crushed by SUV/Truck tail-gating me. Ah, thank you but no.
  • Right -- into the jeep that's trying to kill me? I don't fucking think so.
HOLD MY LINE. Only hope was to hold my line. Save the hot-wash till after. Just 20 seconds and I'd have a jersey-barrier free spot, could dodge left and be safe.

I didn't get it.

MY HORN BLARING FULL. MY HEADLIGHTS FLASHING HIGH/LO/HIGH/LO.

The mother-fucker was right next to me. Paused. darted in. Paused. My HORN is BLARING, CUTTING IN AND OUT AS SHARP AND VARIED AS I CAN, SAME WITH MY LIGHTS. I'm totally boxed in with no out. I've violated THE rule, the #1 rule I've drilled into my children over and over and over again. God fucking dammit.

"Always leave yourself an out."

He hits me.

The pig-fucking syphilitic son of a Bush/McCain Republican hits me HARD.
At thirty miles an hour.

His jeep outweighs my little car probably two to one. He knocks me a solid 2-3 feet across my lane almost in to the jersey barrier. By the time I recover he's half-way IN my lane, where my car and I are stunned but still exist.

It isn't as if he's trying to sneak in between the car ahead of me and my car. He is clearly attempting to put me into the wall. Like I-405 South is NASCAR, and he's a DRIVER.

Yeah. Right.

I rebound away from the wall, back into my lane, HORN BLARING, LIGHTS FLASHING, but instead of falling back into his lane -- in the near crash, the SUV behind me; now it is clear it was an SUV, a BIG one, perhaps an Yukon or a Suburban; has wisely slammed on its brakes so there is now maybe one to two car lengths behind me -- he shoves his car straight at me. I think I'm about to be hit and BLOW OUT MY LUNGS FOR IMPACT as I slide as far left as I can, it's all I can do, but he misses me by at best, inches, sliding behind me directly on my tail.

We continue through the construction zone this way, me in front, him riding my ass. I'm looking for a cop in the zone to flag down; none seen.

The freeway continues single-file perhaps another 20 seconds. I see a space off the the left clearly big enough for both of us and then some. I signal left and pull in, assuming he will follow, we will exchange insurance information and so on.

He pulls around me and accelerates.

Oh.My.Gods. and WTF!

I instantly pull back onto the freeway directly behind him. (All the other cars are giving us LOTS of space. No fools they.) From 10-15 feet behind him, with a clean pair of eye-glasses (new script this year) I put a high-powered halogen flashlight (4D cells, all fresh from last month's trip to Denver, not used once during that trip) on his license plate. Write down the license. Double-check. Triple-check.
GOT HIM.

Follow him at about 60 mph -- the speed limit -- for roughly 4-5 miles. Then it occurs to me how totally stupid this is. I'm a retired paramedic, not a Trooper. This happened on Interstate. I pull off the Interstate at the next exit and under the Interstate overpass, call 911.

A Trooper shows up within 10 minutes, straight off a recruiting poster. Polite, reassuring, his competence is perfect like his shave (less than 30 minutes old, I swear), his radio and how he kept calling me "Sir."

Me, sir? *laughs*

The Trooper and I finish up. The details of which I omit.

I go home.

On the way I stop for carbs, sugar, and a little protein. When you're shocky, you need to eat and hydrate, to get carbs and sugar in your system quickly, with a little protein for balance. I know this. Plus, Maggie reminded me recently in Ginny Bates. *hugs Maggie*

We NEVER know what life will bring us next. Jeep Guy could have killed me like drowning kittens or branding underclassmen.

I'm truly sorry this man's life brought him to the point he committed at least two felonies against me. I've had nights like that, months also. They really truly suck.

Drive safely. Stay buckled. Pay attention and always, Always, ALWAYS...

Always leave yourself an out.

I fucked up the most basic rule of driving Thursday night, and almost bought it.

The White Night Riot, 21 May 1979, and Lesbians Against Police Violence

Today is the 29th Anniversary of the
Most Important Lesbian and Gay Riot Ever


My close friend Maggie Jochild (and good friend of GNB) was there.

The police estimate was there were at least 3,000 lesbian and gays in the rioting. As we all know, police estimates traditionally undercount actual numbers.

The numbers were HUGE.

The rally was lesbian led, Maggie being one of the leaders. The eruption into violence was led by white gay men, Harvey Milk having been their pioneer.

Yet most of those injured were women and or people of color.

The riot began after a jury returned only a verdict of manslaughter in the trial of Dan White (thus the White Night Riot) whose defense team originated the infamous “Twinkie” defense. (Details at the link.)

White, a former police officer and San Francisco City Supervisor, had been charged with first-degree murder for the assassinations of San Francisco City Mayor George Moscone and San Francisco City Supervisor Harvey Milk.

A note about the so-called “Twinkie” defense. While it was played in court, literally, as that White had been eating so much junk-food that it diminished his capacity, thus being one of the reasons he “lost it”, what really was going on in court was emphasis on the double-meaning of the word “Twinkie.” White's defense team rammed home for the jury how Milk smirked at him, while refusing to hire him back. The faggot, “smirked.”

Obviously, no former cop such as White, could take a faggot besmirching his honor and masculinity by not just refusing to hire him back, but “smirking” at him. Had White only killed Mayor Moscone (a true progressive) White would no doubt have been convicted of first-degree murder. But kill that faggot Milk, the “Twinkie” for smirking... Shit-fire boy, that faggot had it coming.

Thus... the White Night Riot.

Meta Watershed

Today is the 29th anniversary of the largest lesbian and gay riot in the history of the world. Not only was I there, I was one of the women in Lesbians Against Police Violence responsible for the rally from which it arose.

I've written about LAPV in other posts, such as Tania: 33 Years Later. In one, Dianne Feinstein, Opportunist, I give a good brief history of the events leading up to Dan White's cold-blooded assassinations of San Francisco Mayor George Moscone and City Supervisor Harvey Milk. I refer you to that for background.

Another excellent source is an article by LAPV members and women I worked closely with, Pam David and Lois Helmbold, in Radical America, Vol 13, no.4 July- August 1979, found online at Sexuality and the State: The Defeat of the Briggs Initiative and Beyond (scroll down about 2/5 of the document to find the pertinent Radical America extract).

LAPV stood in radical opposition to police harassment of minority communities. We saw Dan White's assassination as a rage reprisal by a former cop against progressive forces (not just gay) and linked it to the larger picture of male and white domination. I think it's critical to remember that the riot which came from our agitation was the result of revolutionary lesbians speaking out against the ultimate forces of power in our society, not a bunch of "gays" upset about a verdict.

Several years ago I wrote my own memoir of the event. I'm going to include that below. Not long afterward, I was interviewed by Christina B. Hanhardt, who was writing a doctoral thesis in American Studies at New York University on "Butterflies, Whistles, and Fists: Safe Streets Patrols and the ‘New’ Gay Ghetto". Her interview with me and other LAPVers, as well as review of primary source documents (mostly from the papers I donated to the Meg Barnett Papers in the Queer Nation Collection at the Gay, Lesbian, Bisexual Transgender Historical Society in San Francisco) formed Chapter Two of her thesis, "Safe Space: Sexual Minorities, Uneven Urban Development, and the Politics of Violence". At a later date, I will include this chapter in a post covering LAPV in more historical depth.

THE WHITE NIGHT RIOT

The day after the riot, my feelings about it began to change. I was driving a morning route then, delivering something called Veggie Rolls to natural foods store in San Francisco. There were dozens of such stores in 1979. I had arranged my route to go through the Mission, Noe Valley, Bernal and Potrero Hill neighborhoods first, hit SoMa and downtown during the mid morning lull, then head out to the Haight and the Avenues, ending up at Ocean Beach in the afternoon, where I fed the day-old rolls to a keening flock of gulls. On the morning of May 22, however, I began my day by driving past City Hall on the way to Polk Gulch.

I approached it from an indirect route so I could look across the square first and see if cops were there. There were scorched places near curbs here and there, but the burned-out police cars had already been towed away. There was a knot of 20-30 people standing on the sidewalk across from City Hall, standing with their arms at their sides, staring, not talking to each other. Every window on the front facade of the block-long building was covered with plywood, raw and bright in the morning light. There were no parking meters left on that block. I stopped and watched the people for a minute. They seemed to be in shock. I felt a thrill go through me.

While I chatted daily with the managers of the stores where I delivered, and with a few of them I actually conversed (mostly the dykes in the Coop system), the majority of the stores were owned by either white boy hippies or what would soon be called yuppies, and my interest in what they had to say was limited. I knew I was identified as a lesbian by them because one of them had refused to let me help distribute his products, saying I was too “rough looking” for his clientele. I surely hated that man from then on.

On this day, however, there was something new. It mostly took the form of a second look, after the initial glance of recognition. It was as if a new dimension had suddenly been added to my identity as queer, as if they had overnight found out it also meant I could fly, or was immortal. They looked at me in such a speculative way, I wanted to say to every one of them, “Yeah, I was there. Next time we might come for YOU.” I could smell the fear on them, and I liked it. It was as close to respect as I had ever gotten from the straight world.

Billy Wolfe, 16, has been a target of bullies, since he was 12.

Knocked out, stitched up, left bleeding and bruised lying on the street and the floor at school, his mother has one simple hope: "I pray to God every day they don't kill him," said Ms. Wolfe. "Because of all the things that have happened I honestly don't know if he's going to be O.K."

A car the color of a school bus pulls up with a boy who tells his brother beside him that he’s going to beat up Billy Wolfe. While one records the assault with a cellphone camera, the other walks up to the oblivious Billy and punches him hard enough to leave a fist-size welt on his forehead.

The video shows Billy staggering, then dropping his book bag to fight back, lanky arms flailing. But the screams of his sister stop things cold.

Whatever the reason, addressing the bullying of Billy has become a second job for his parents: Curt, a senior data analyst, and Penney, the owner of an office-supply company. They have binders of school records and police reports, along with photos documenting the bruises and black eyes. They are well known to school officials, perhaps even too well known, but they make no apologies for being vigilant. They also reject any suggestion that they should move out of the district because of this.

Judging by school records, at least one official seems to think Billy contributes to the trouble that swirls around him. For example, Billy and the boy who punched him at the bus stop had exchanged words and shoves a few days earlier.

But Ms. Wolfe scoffs at the notion that her son causes or deserves the beatings he receives. She wonders why Billy is the only one getting beaten up, and why school officials are so reluctant to punish bullies and report assaults to the police.

The Wolfes are not satisfied. This month they sued one of the bullies “and other John Does,” and are considering another lawsuit against the Fayetteville School District. Their lawyer, D. Westbrook Doss Jr., said there was neither glee nor much monetary reward in suing teenagers, but a point had to be made: schoolchildren deserve to feel safe.

This just breaks my heart. As someone who endured my share of bullying when I was a kid, from being psychologically tormented by a troubled kid who was Catholic and delighted in telling me I would go to hell when I died to the boy in fourth grade who used to hit me every day to the time I was asked by a high school principal what I did to make so-and-so angry, I'm appalled that more than thirty years after I finished high school, nothing has changed.

That schools are still blaming the victim because they don't know what else to do is reprehensible. And the prevalence of social networking web sites make tormenting misfits an even more efficient operation.

I think back to the recent case of Megan Meier, who committed suicide at the age of thirteen after a boy she liked had turned on her, and the boy turned out to be a fake MySpace account set up by the parents of a girl with whom she'd had a falling out. And I wonder what on earth parents and schools in this country are doing when they want to put every kid whose brain functions differently on medication, but when you have actual cases of kids being tortured by their classmates, the schools blame the kid being victimized and the parents look the other way.

Ass Kicking 101: Age Nine


I got my first serious beating at age nine (not counting Dad and any of the times he beat the shit out of me.) It was downtown at the Temple of Music and Art after choir practice. At nine I was in the Tucson Boys Chorus, working my way up towards the Touring group which I wouldn't make till I turned thirteen after a year spent living in Europe. I attended church regularly and was to all outward appearances a good boy. Boy were appearances wrong.

The problem with genius is simple. Genius plays by its own rules. Yet lives in the world with others. I tested out in the 160's both as a kid and then in my late teens on the adult tests. Certainly there are many people more adapt at solving intelligence tests than I am, but so far as relating to people who are "average", I didn't have a clue for a long, long time. Till I figured out how to put a stop to the bullying, people tended to beat the shit out of me because I was socially clumsy and freely volunteered my opinion that not only was I right, but everyone else was stupid for not seeing life my way. *laughs*

Dad forgot to pick me up on time so I waited. And waited. And waited. Eventually two older kids, teenagers, showed up down in South Tucson where we rehearsed. After questioning me for a bit, they started to hit me. I was different, that's what mattered. My answers were off; I knew too damn much for a freaking nine-year-old and didn't yet know how to hide it. (Sometimes I still don't.) So they hit me. First a little, then a lot. Didn't matter what I said. Didn't matter what I knew. Only mattered that they were bigger and stronger. They beat on me with fists, boots, belt buckles, rocks, whatever was handy, for close to forever. Had me cornered all the way upstairs back where no one could hear me scream. It got dark as they kept it up. Eventually I wore out their fists on my head and they left.

Dad got there several hours later. I was huddled under a lamp post, waiting. Bloody. Not crying.

What is happening to Billy is wrong.

He is a strong young man to be standing up to this. I applaud his parents for suing the bullies directly, and hope they soon sue the school district as well.

The refusal of the school administration to deal with these attacks is wrong.

Bullying is wrong -- verbal, sexual, classism, racism, and physical.

Attacking someone because they're different is wrong.

All of these are forms of violence against people.

All bullying (violence) is wrong, both individually and in mobs.

Anyone who participates in mobbing or bullying is wrong.

Anyone who watches mobbing or bullying and doesn't help stop it is wrong.

I Must Be Right Even When I Know I'm Wrong

People need to be right.

People need to be right so badly we (me too) will stick with being right even when we know we're wrong.

That's what happens here with Nathan Jones.

When you watch the tape, starting at 4:30 in to the tape, Nathan finally comes around and admits he is sorry that the Virgina Tech students and friends and family who viewed the pictures (of him and others in costume of dead students) -- to the extent that he played a part in that, he's sorry.

But at 4:55, as the CNN anchor tries to get Nathan to make his apology more explicit, he instantly retreats and defends his actions, taking back even the limited apology he'd made.

People need to be right no matter what it costs them. And it costs them. Their reputation, love, money, their health. People die in order to be right. What do you think religious wars are about?

People who are willing to be wrong, are people who can learn quickly, make progress, adapt to a world of reality as it occurs for them, instead of being stuck in their mental images.

The best people in any domain are people who are willing to be wrong, and who communicate frankly and candidly about their failures.

The more failures I make, the faster I get to my successes. When I screw up at GNB, I almost always send out an email to my colleagues announcing the fact, detailing how I screwed up, and what I'm going to do next (or asking for advice.)

I screw up faster, more often, and recover quicker than anyone I know. Because I'm not at all timid about screwing up, and I'm passionate about communicating.

For this to work, you have to be willing -- no, committed -- to letting go of a position that's wrong. Even if it makes you look like an ass. Especially then.

And it isn't as if your buddies are going to be all enlightened and say, "Oh, Jesse. You're so brave. I see now how you're just letting go of a position you're holding on to where you think you have to be right. Thank you for being willing to be wrong, in order to move the communication forward within our group. I honor you."

*snorts*

They're going to say (or at least think), "That was really stupid. Don't do it again, asshole. Next time, don't fucking admit to being wrong. You made our whole group look bad. And for Gods sake, if you're dumb enough to get caught, lie!!!"

What I and the people like me who have been trained to communicate no matter what, are attempting to do, is change the culture, from one based on lies and distrust, to one based on communication and trust.

I'm right, probably 85-90% of the time. Not talking about how often I make typing errors, but the choices I make. Of that last 10-15%, I have trusted friends, colleagues, professionals, and family I check in with all the time, especially on big stuff. I'm not at all afraid to reverse myself, even if temporarily it makes me look like an idiot. Anyone who knows me well, knows I have the capacity to screw up in a major way. It's evidence I'm taking big bites out of life.

(There have been a few stretches when the percentage was much higher. Sometimes much higher, during which I was checking damn near everything. I had children I had to protect against myself.)

I like to keep my mistake percentage at about 10-15%. Any less would mean I'm spending too much time trying to be perfect. Any more would mean too much time correcting errors. 1 to 1.5 out of 10 means I'm taking risks and learning from them.

Having to be right is a basic human drive. It's built in, part of our linguistic soup.

Recognizing that having to be right is part of our Automatic Pilot mechanism, just like breathing or having a heart beat, starts to give us some options. Because once we recognize something as Automatic Pilot, at least with the linguistic parts, we begin to have the option to choose otherwise.

Because being right all the time isn't always, well, right. Sometimes it's just stupid.

Officials with the campaign confirmed that there were two workers taken hostage in the office on 28 North Main St., and NBC News reported that the man demanded to speak to Clinton.

Clinton, who is not in New Hampshire, canceled a National Democratic Committee meeting in Virginia.

A woman and her baby told workers at a neighboring business that she was released by the hostage-taker.

"A young woman with a 6-month or 8-month-old infant came rushing into the store just in tears, and she said, 'You need to call 911. A man has just walked into the Clinton office, opened his coat and showed us a bomb strapped to his chest with duct tape,'" witness Lettie Tzizik said.

"There are sharp shooters on the roof, and police are negotiating with someone in the building," said another witness, who did not want to be identified. "The police are notifying all the business owners on the street to evacuate. There are fire trucks behind the Hillary Clinton office."

Wal-Mart Defends Its Staff. Oh Wait, No, It Doesn't.

Wal-Mart Customer Service Manager Fired After Being Assaulted By Shoplifter

I guess the Customer IS always right.

Even when right is defined as 18-year-old Angel Rivera of the City of Newburgh being:

  • gets caught shoplifting,
  • is offered a polite way out without any trouble,
  • Runs out of the store,
  • Runs back in and SCREAMS at the soon-to-be fired Manger,
  • Smashes a McDonald's drink on her shoulder,
  • "Landed a hard hook to her cheek",
  • Punched someone else in the eye,
  • Spit in someone else's face, and
  • "Pummeled another manager."
All before Ms. Rivera was hauled off to jail under arrest on "robbery and assault, felonies, and petty larceny." Security cameras having her dead to rights on the major charges.

Obviously this breach of Wal-Mart's peace and decorum calls for the firing of the woman who CAUSED IT ALL TO HAPPEN, the Customer Service Manager, Victoria Smith.

If only she'd had the good sense to just let the alleged thief steal from Wal-Mart, Ms. Rivera wouldn't have gone bat-shit fucking insane and assaulted FOUR people.

Thank Goodness Wal-Mart provides World-Class Health Care and Vacation benefits to all employees -- as behooves one of the world's largest and most profitable companies -- and trusts its employees and managers to do the right thing. I'm sure each of these people got adequate time off to heal from the attack, along with proper counseling, and that no one is being scapegoated in any way for the random attack of a criminal.

That crazy & quirky Wal-Mart. Always doing the right thing.

Someone should do a crazy & quirky network television show about a triangle of crazy & quirky kids who love, live and work at... Wal-Mart.

Judge Screws Sex Worker In Court

A defendant in the Philadelphia courts was accused of raping a hooker at gunpoint, and giving three buddies a ride.

That's gang-rape at gunpoint.

That night the sex-worker -- WITH A GUN POINTED AT HER -- "gave permission" for sex. In tears.

Municipal Judge Teresa Carr Deni drops all rape and assault charges to armed robbery for "theft of services."

Yes... you heard correctly.

Deni told me she based her decision on the fact that the prostitute consented to have sex with the defendant.

"She consented and she didn't get paid . . . I thought it was a robbery."

The prostitute, a 20-year-old single mother, agreed to $150 for an hour of oral and vaginal sex on Sept. 20, according to assistant district attorney Rich DeSipio. The arrangements were made through her posting on Craigslist.

She met the defendant, Dominique Gindraw, 19, at what she thought was his house, but which turned out to be an abandoned property in North Philadelphia.

He asked if she'd have sex with his friend, too, and she agreed for another $100.

The friend showed up without money, the gun was pulled and more men arrived.

When a fifth man arrived and was invited to join, DeSipio said, he asked why the girl was crying - and declined. He helped her get dressed so she could leave.

It's true the prostitute negotiated sex with the defendant - but not unprotected gang sex at gunpoint.

"The Legislature has defined sex by force as rape," said DeSipio, accusing the judge of "rewriting her own laws."

DeSipio said Judge Deni's ruling was based, not on the law, but on moral contempt.

"Certainly if a jury wants to make that judgment, they're entitled to. But for a judge to make a judgment on a human being - I've never seen that before."

Deni did seem contemptuous of the victim:

"Did she tell you she had another client before she went to report it?" Deni asked me yesterday when we met at a coffee shop.

"I thought rape was a terrible trauma."

A case like this, she said - to my astonishment - "minimizes true rape cases and demeans women who are really raped."

The defendant was charged in an identical incident involving a 23-year-old woman four days later, DeSipio said.

Neither woman knew the other and both told identical stories. The other men involved in the attack couldn't be identified.

DeSipio was so stunned by Deni's ruling in the first case that he refused to present the second one.

"I wouldn't demean her that way," he said of the second victim, calling the proceedings "a farce."

Judge Deni then threw out the second case for failure to prosecute.

Police Detective Jack Ryan, who investigated the incidents, said the victims in the two cases "were in fear for their lives. Since they saw one of the doers really well, it crossed both of their minds that they'd be killed."

Deni's decision to drop the sex charges is " frankly, appalling," he said.

DeSipio said he'll file to reinstate the charges in both cases right away - before a different judge, of course.

You live in a fucked up world, Judge. It's Teresa's moral world of sin, pleasure and pain.

Problem is, when you're on the bench, we count on you for the Rule of Law.

Get it right, or get the hell off the bench.

Gang rape at the point of a gun is rape. It's not possible to give consent with a gun aimed at you.
